On March 24, 2010, Class Counsel filed a motion to allow damages to be computed on a class-wide basis for the Waiting List subclass. The motion (1) asks the Court to certify the Waiting List subclass to determine the amount of each claimant’s damages and (2) proposes a process to determine damages by a formula that computes damages based upon the number of years that a beneficiary waited to receive a homestead. A copy of the filed motion is on the Important Documents page. Class Counsel also filed a proposed Case Management Plan, which outlines how the remainder of the case will be decided. The Case Management Plan includes a declaration from Plaintiffs’ damages expert on how damages will be computed and suggests that a special master be appointed to recommend a damages award for the class. A copy of the Case Management Plan is on the Important Documents page. The hearing for the motion is on May 26, 2010 at 1:30 p.m.. The hearing will take place at the First Circuit Court house at 777 Punchbowl Street. Because we still have not been assigned a judge for this case, we do not know which judge will preside over the hearing. We will post that information on this website as soon as we receive it. |
